OFFICIAL CONTEST RULES

CONTEST PERIOD:

The Montreal Latin Music Festival Contest (the “Contest”) begins on May 16, 2024 at 12:00 PM Eastern Time and ends on May 20, 2024 at 11:59 PM Eastern Time (the “Contest Period”).

AGREEMENT TO BE LEGALLY BOUND BY THESE RULES:

By participating in this Contest, you are signifying your agreement that you have read and agree to be legally bound by these Official Contest Rules (the “Rules”).

ELIGIBILITY:

The Contest is only open to residents of Canada who are nineteen (19) years of age or older at the time of entry, except employees, representatives or agents (and those with whom such persons are living, whether related or not) of Royal Bank of Canada (the “Sponsor”), its parent companies, subsidiaries, affiliates, prize suppliers, advertising/promotion agencies and any other individual or entity involved in the development, production, administration, or fulfillment of the Contest (collectively, the “Contest Parties”).

SOCIAL PLATFORM NOT INVOLVED:

The Contest is in no way sponsored, endorsed or administered by, or associated with Instagram (the “Social Platform”). The Social Platform is hereby completely released of all liability by each entrant in this Contest. Any questions, comments or complaints regarding the Contest must be directed to the Sponsor and not to the Social Platform. You may only use one (1) Social Platform account (each, an “Account” and collectively, the “Accounts”) to participate in this Contest. You are solely responsible for ensuring your Account settings are set to be able to receive notification messages, monitoring your Account for such notification messages and following all instructions contained in such notification messages that may be received from the Sponsor regarding your participation in the Contest.

HOW TO ENTER:

No purchase necessary. You may earn an entry in the Contest (each, an “Entry” and collectively, the “Entries”) as follows:

Instagram:

To enter via Instagram, you must log-in to your Instagram Account and visit the Sponsor’s Instagram Account at @rbcxmusic (the “Sponsor’s Account”). Next, locate the Contest post (the “Contest Post”) that has been posted on the Sponsor’s Account by or on behalf of the Sponsor. After locating the Contest Post, provide a comment on the Contest Post that: tags a friend’s active Instagram account. In addition, you must become a “follower” of the official @rbcxmusic account on Instagram (note: you can un-follow at any time after the Contest ends without impacting your chances of winning). When all required steps of the entry process are complete, you will automatically be eligible to earn one (1) Entry in the Contest.

To be eligible, all content and materials associated with your Entry (collectively, the “Entry Materials”) must: (i) be submitted and received in accordance with these Rules during the Contest Period; (ii) include all required components and materials noted above; (iii) be in accordance with these Rules, including, but not limited to, the specific Participation Requirements listed below; and (iv) be in accordance with the terms, rules, policies and guidelines of the Social Platform (the “Social Platform Rules”) (all as determined by Sponsor in its sole and absolute discretion). Standard data rates apply to participants who choose to participate in the Contest via a mobile device. To be eligible, your Entry must be submitted and received in accordance with these Rules during the Contest Period.

ENTRY LIMIT:

There is a limit of 1 Entry per person during the Contest Period. If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to: (i) exceed any of the limits stated in these Rules; and/or (ii) use multiple Accounts, names, identities, email addresses and/or any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or to disrupt this Contest; then he/she may be disqualified from the Contest in the sole and absolute discretion of the Sponsor. An Entry may be rejected if (in the sole and absolute discretion of the Sponsor): (i) the Entry (including, but not limited to, any associated Entry Materials) is not submitted and received in accordance with these Rules during the Contest Period; and/or (ii) the Entry Materials accompanying the Entry are not in compliance with these Rules (including, but not limited to, the specific Participation Requirements listed below) and/or the Social Platform Rules (all as determined by Sponsor in its sole and absolute discretion). The Released Parties (defined below) are not responsible for late, lost, misdirected, delayed, incomplete or incompatible Entries or any other Contest-related information (all of which are void).

VERIFICATION:

All Entries, Entry Materials and entrants are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of any Entry, Entry Materials or any other information submitted (or purportedly submitted) for the purposes of this Contest; and/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with these Rules. Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may result in disqualification in the sole and absolute discretion of the Sponsor. The sole determinant of the time for the purposes of this Contest will be the Contest server machine(s).

PARTICIPATION REQUIREMENTS:

BY SUBMITTING AN ENTRY, YOU AGREE THAT THE ENTRY (AND EACH INDIVIDUAL COMPONENT THEREOF – INCLUDING, WITHOUT LIMITATION, THE ENTRY MATERIALS) COMPLIES WITH ALL CONDITIONS STATED IN THESE RULES. THE RELEASED PARTIES (DEFINED BELOW) WILL BEAR NO LIABILITY WHATSOEVER REGARDING: (I) THE USE OF YOUR ENTRY (OR ANY COMPONENT THEREOF – INCLUDING, WITHOUT LIMITATION, THE ENTRY MATERIALS); (II) PARTICIPATION IN ANY CONTEST-RELATED ACTIVITIES; (III) ANY USE, COLLECTION, STORAGE AND DISCLOSURE OF ANY PERSONAL INFORMATION; AND/OR (IV) IF DECLARED A/THE WINNER, A/THE PRIZE (INCLUDING ANY USE OR MISUSE OF A/THE PRIZE). THE RELEASED PARTIES (DEFINED BELOW) SHALL BE HELD HARMLESS BY YOU IN THE EVENT IT IS DISCOVERED THAT YOU HAVE DEPARTED FROM OR NOT OTHERWISE FULLY COMPLIED WITH ANY OF THESE RULES AND/OR THE SOCIAL PLATFORM RULES. THIS RELEASE AND INDEMNITY SHALL CONTINUE IN FORCE FOLLOWING THE TERMINATION OF THE CONTEST AND/OR AWARDING OF ANY/THE PRIZE.

By participating in the Contest, you hereby warrant and represent that any Entry Materials you submit:

The Sponsor and/or its promotional agency or designated content moderator (the “Reviewer”) reserves the right to screen all Entry Materials. Any Entry Materials that the Reviewer deems, in its sole and absolute discretion, to violate the terms and conditions set forth in these Rules are subject to disqualification. The Reviewer reserves the right, in its sole and absolute discretion at any time and for any reason, to remove any Entry Materials (or any part thereof) and/or to request an entrant to modify, edit and/or re-submit his or her Entry Materials (or any part thereof) in order to ensure that the Entry Materials comply with these Rules, or for any other reason. If such an action is necessary at any point during or after the Contest, then the Sponsor reserves the right, in its sole discretion, to take whatever action it deems necessary based on the circumstances – including, without limitation, disqualifying the Entry Materials (and therefore the corresponding Entry and/or the associated entrant) – to help ensure that the Contest is being conducted in accordance with the letter and spirit of these Rules.

LICENSE:

By entering the Contest and submitting an Entry, you (and, if you are a Minor, your parent or legal guardian): (i) without limiting the Social Platform Rules, grant to the Sponsor, in perpetuity, a non-exclusive, worldwide license to publish, display, reproduce, modify, edit, make available, communicate to the public by telecommunication and otherwise use your Entry Materials (and each component thereof), in whole or in part, for advertising or promoting the Contest or for any other reason in any type of media; (ii) waive all moral rights in and to your Entry Materials (and each component thereof) in favour of the Sponsor (and anyone authorized by the Sponsor to use such Entry Materials); and (iii) agree to release and hold harmless the Released Parties (defined below) from and against any and all claims, damages, liabilities, costs, and expenses arising from use of his/her Entry Materials (or any component thereof), including, without limitation, any claim based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related or other cause of action whatsoever.

PRIZES:

PRIZE DESCRIPTION

There will be 5 prizes (each, a "Prize"). Each Prize consists of:

• Two (2) 2 Day GA tickets to the Fuego Fuego Music Festival in Montreal, QC at Olympic Park on May 25-26, 2024 (“Festival”), with a total approximate retail prize value of each prize is $236 CAD. Parking, travel and accommodations not included and are the sole responsibility of winner and guest. Ticket delivery method is at sole discretion of Live Nation which will be either sent to winner by mail, email, mobile ticketing or placed at venue Will Call the day of Festival under the winner’s name. Winner must be present to pick up tickets and a valid photo ID will be required if tickets are placed at Will Call. Winner and guest must be at least nineteen (19) years of age and must abide by all venue/Festival and event policies: https://www.festivalfuegofuego.com/en (link opens in to external site), to include but not limited to, showing a valid photo ID at venue for age verification and/or identification purposes if requested. Live Nation reserves the right to revoke full or partial prize from any winner or winner’s guest who it and/or venue/Festival personnel deem may, in their sole discretion, be intoxicated, be a safety risk, have violated any venue/Festival policy or law, and/or may bring Live Nation into disrepute. Winner understands that there are inherent risks involved in being in public spaces and that these risks may be present before, during and after the Festival. Resale of tickets is prohibited. By claiming tickets, you agree to Live Nation’s Terms of Use and to abide by the health and safety measures in effect at the time of your Festival, which may include, but not be limited to, wearing masks, providing proof of vaccination status and/or providing proof of negative COVID-19 status. Should the Festival be cancelled, you will be notified as soon as reasonably possible.
• Admission (and, if applicable, any ticket(s)) is subject to the terms and conditions of the Festival, which must accepted as awarded and is not transferable, assignable or convertible to cash (except as may be specifically permitted by Sponsor in its sole and absolute discretion). No substitutions except at the Sponsor’s option. Sponsor reserves the right, in its sole and absolute discretion, to substitute any of this prizing or a component thereof with a prize of equal or greater retail value, including, without limitation, but at Sponsor’s sole and absolute discretion, a cash award. All costs not expressly indicated above as forming part of this prizing are the applicable confirmed winner’s sole responsibility. All characteristics and features of this prizing, except as otherwise explicitly described above, are at the Sponsor’s sole and absolute discretion. The Released Parties (defined below) will be in no way responsible in the event that any part of the event is delayed, cancelled, postponed or rescheduled for any reason whatsoever. Without limiting any of the foregoing, the following additional terms and conditions apply to the prize: (i) the confirmed winner (and his/her guest(s), as applicable) must have all necessary documentation to permit participation in the prize (including without limitation any required valid proof of vaccine or exemption documentation, proof of negative COVID-19 test documentation, and/or any other COVID-19 documentation), failing which he/she may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the prize); (ii) the confirmed winner, and his/her guest(s) as applicable, are solely responsible for any COVID-19 test expenses, COVID-19 quarantine requirements and related expenses, and travel or medial insurance costs (if applicable); (iii) the Released Parties (defined below) are not responsible for any delay, postponement, suspension, rescheduling or cancellation of any aspect of the prize, for any reason (including without limitation, if fulfilment of the prize, or any part thereof, is rendered impossible, infeasible, unsafe or impractical for any reason, including without limitation due to illness or health risks, or any governmental or health authority orders, measures, directives or guidance in response to such illness or risks, such as, without limitation, those that may be implemented to mitigate COVID-19 transmission, or due to any pandemic-related law, regulation, order, policy, guideline, strike, travel restriction, venue policy, restriction, or other cause of any kind or nature whatsoever), and for greater certainty are not obligated to offer any compensation and/or substitute prizing as a result; and (iv) by participating in the prize, the confirmed winner (and each of his/her guest(s) as applicable): (a) signifies that he/she understands, acknowledges and accepts that participation in the prize may involve danger and/or exposure to risks and hazards (including without limitation as may be due to the nature of the prize and as may be due to possible COVID-19 exposure or infection), whether arising from foreseeable or unforeseeable human error and negligence, and that, as a result, he/she may suffer damage to personal property, serious personal injury, illness or even death; (b) signifies that he/she acknowledges and agrees that the Released Parties (defined below) have not made any warranties, guarantees or representations about his/her safety while participating in the prize; and (c) warrants and represents that he/she has evaluated the nature, scope, and extent of the risks involved, and freely and voluntarily agree and assume any and all risks of personal injury, illness, death arising out of or connected with his/her participation in the prize.

There is a limit of one (1) Prize per person.

PRIZE WINNER SELECTION PROCESS:

On May 21, 2024 (the "Selection Date") in Toronto, Ontario at 9:00 AM Eastern Time, five (5) eligible entrants will be selected by random draw from among all eligible Entries submitted and received in accordance with these Rules during the Contest Period.

The odds of winning depend on the number of eligible Entries submitted and received in accordance with these Rules during the Contest Period.

WINNER NOTIFICATION PROCESS:

The Sponsor or its designated representative will make a minimum of 1 attempt to contact each potential Prize winner (using the information provided at the time of entry) within 1 business day of the Selection Date. If a potential Prize winner cannot be contacted within 3 business days of the Selection Date, or if there is a return of any notification as undeliverable; then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to select an alternate potential Prize winner following the same winner selection procedure described above (with the necessary amendments), in which case the foregoing provisions of this section shall apply to such new potential Prize winner.

WINNER CONFIRMATION PROCESS:

BEFORE BEING DECLARED A CONFIRMED PRIZE WINNER, each potential Prize winner will be required to: (a) correctly answer a mathematical skill-testing question without mechanical or other aid (which may, in the sole and absolute discretion of the Sponsor, be administered online, by email or other electronic means, by telephone, or in the Sponsor’s form of declaration and release); and (b) sign and return within three (3) business days of notification the Sponsor’s declaration and release form, which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the Prize (as awarded); (iii) releases the Contest Parties, Live Nation Canada, Inc. (“Live Nation”), Gestion Evenko Festival Inc. (“Fuego Fuego Festival”), Instagram and each of their respective officers, directors, employees, agents, representatives, successors and assigns (collectively, the “Released Parties”) from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the Prize or any portion thereof; and (iv) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner or medium whatsoever, including print, broadcast or the internet. If the potential Prize winner: (a) fails to return the properly executed Contest documents within the specified time; (b) cannot accept (or is unwilling to accept) the Prize (as awarded) for any reason; (c) fails to correctly answer the skill-testing question; and/or (d) is determined to be in violation of these Rules (all as determined by the Sponsor in its sole and absolute discretion); then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to select an alternate potential Prize winner following the same winner selection procedure described above (with the necessary amendments), in which case the foregoing provisions of this section shall apply to such new potential Prize winner. The Sponsor will have final discretion in selecting the winner in the event of a tie or for any other reason.

GENERAL CONDITIONS:

All Entries become the property of the Sponsor. This Contest is subject to all applicable federal, provincial and municipal laws. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without the right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Entries and/or entrants. ANYONE DEEMED BY THE SPONSOR TO BE IN VIOLATION OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME.

The Released Parties will not be liable for: (i) any failure of any website during the Contest; (ii) any technical malfunction or other problems of any nature whatsoever, including, without limitation, those relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (iii) the failure of any Entry or other information to be received, captured or recorded for any reason whatsoever, including, but not limited to, technical problems or traffic congestion on the internet or at any website; (iv) any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating in the Contest; and/or (v) any combination of the above.

Without limiting the generality of the foregoing, by participating in the Contest, each entrant releases the Released Parties from any and all liability in connection with this Contest and his/her participation therein.

In the event of a dispute regarding who submitted an Entry, the Sponsor reserves the right, in its sole and absolute discretion, to require any individual who purports to be the entrant that submitted the Entry in question to provide proof to the complete satisfaction of the Sponsor (as determined by the Sponsor in its sole and absolute discretion) of being the entrant that submitted such Entry. Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may result in disqualification (as determined by the Sponsor in its sole and absolute discretion).

The Sponsor reserves the right, in its sole and absolute discretion, to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, in the event of any cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules, including, without limitation, any error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud or technical failure. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest in any way (as determined by Sponsor in its sole and absolute discretion) is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. The Sponsor, in its sole and absolute discretion, reserves the right to cancel, amend or suspend this Contest, or to amend these Rules, in any way without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever. Without limiting the generality of the forgoing, the Sponsor reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law.

By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with his/her Entry only for the purpose of administering the Contest and in accordance with the Sponsor’s privacy policy (available at: http://www.rbc.com/privacysecurity/ca/our-privacy-policy.html).

This section does not limit any other consent(s) that an individual may provide the Sponsor or others in relation to the collection, use and/or disclosure of their personal information.

The Sponsor reserves the right, in its sole and absolute discretion, to adjust any of the dates, timeframes and/or other Contest mechanics stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any entrant or Entry with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.

In the event of any discrepancy or inconsistency between the terms and conditions of these English Rules and disclosures or other statements contained in any Contest-related materials or website(s), including, but not limited to: an entry form, French version of these Rules, and/or point of sale, television, print or online advertising; the terms and conditions of these English Rules shall prevail, govern and control to the fullest extent permitted by law.

Live Nation Canada, Inc. (“Live Nation”) and Fuego Fuego Festival are not Sponsors of the Contest, and in no way responsible for the administration of the Contest, the verification of winners or the fulfillment of prizing. All inquiries regarding the Contest should be directed to Sponsor. Fuego Fuego is a trademark of Gestion Evenko Festival Inc.

Le concours s’adresse aux résidents du Canada qui sont âgés de dix-neuf (19) ans ou plus au moment de la participation, à l’exception des employés, représentants et mandataires (et des personnes domiciliées avec eux, qu’elles aient ou non un lien de parenté avec eux) de la Banque Royale du Canada (le « commanditaire »), de ses sociétés mères, filiales, sociétés affiliées, fournisseurs de prix, agences de publicité ou de promotion, et de toute entité ou de toute autre personne ayant participé à la conception, à la production, à l’administration ou à l’exécution du concours (collectivement, les « parties liées au concours »).

PLATEFORME SOCIALE NON IMPLIQUÉE :

Le concours n’est d’aucune façon commandité, endossé ou administré par Instagram (la « plateforme sociale »), et n’y est pas associé. La plateforme sociale est par les présentes entièrement dégagée de toute responsabilité par chaque participant à ce concours. Les questions, commentaires ou plaintes concernant le concours doivent être acheminés au commanditaire, et non à la plateforme sociale. Vous ne pouvez utiliser qu’un (1) compte de plateforme sociale (chacun, un « compte » et collectivement, les « comptes ») pour participer au concours. Il vous incombe exclusivement de vous assurer que les paramètres de votre compte sont configurés de façon à pouvoir recevoir des messages de notification, de surveiller votre compte pour repérer ces messages et de suivre toutes les instructions contenues dans ces messages qui pourraient être reçus du commanditaire en ce qui concerne votre participation au concours.

COMMENT PARTICIPER AU CONCOURS :

Pour participer par l’intermédiaire d’Instagram, vous devez ouvrir une session dans votre compte Instagram et vous rendre sur le compte Instagram du commanditaire à @RBCxMUSIC (le « compte du commanditaire »). Vous devez ensuite, trouver la publication du concours (la « publication du concours ») qui a été publiée sur le compte du commanditaire par le commanditaire ou en son nom. Après avoir localisé la publication du concours, ajoutez-y un commentaire en mentionnant le compte Instagram actif d’un ami. Vous devez en outre devenir un « abonné » du compte officiel @RBCxMUSIC sur Instagram (nota : vous pouvez vous désabonner n’importe quand après la fin du concours sans qu’il n’y ait d’incidence sur vos chances de gagner). Lorsque toutes les étapes requises du processus de participation sont terminées, vous serez automatiquement admissible à une (1) participation au concours.

LIMITE DE PARTICIPATION :

Une limite d’une (1) participation par personne s’applique durant la période du concours. Si le commanditaire découvre (à l’aide d’une preuve ou d’un autre renseignement fourni au commanditaire ou autrement découvert par lui) qu’une personne a tenté : i) de dépasser toute limite stipulée dans le présent règlement ; ou ii) d’utiliser plusieurs comptes, noms, identités, adresses électroniques ou un moyen automatisé, une macro, un script, une aide robotique ou un ou plusieurs autres systèmes ou programmes pour s’inscrire ou autrement participer à ce concours ou nuire à son bon fonctionnement, elle pourrait se voir exclue du concours à la discrétion du commanditaire. Une participation pourrait être rejetée à la discrétion du commanditaire si : i) la participation (y compris tout matériel de participation connexe) n’est pas soumise et reçue conformément au présent règlement pendant la période du concours ; ou ii) le matériel de participation soumis avec la participation n’est pas conforme au présent règlement (notamment, aux exigences de participation particulières énumérées ci-dessous) ou aux règles de la plateforme sociale (le tout comme le détermine le commanditaire à sa discrétion). Les parties exonérées (définies ci-dessous) ne sont pas responsables des participations ou autres renseignements liés au concours tardifs, perdus, mal acheminés, retardés, incomplets ou incompatibles (qui sont tous nuls).

VÉRIFICATION :

L’ensemble des participations, du matériel de participation et des participants peuvent faire l’objet d’une vérification à tout moment et pour quelque raison que ce soit. Le commanditaire se réserve le droit, à sa discrétion, d’exiger une preuve d’identité ou d’admissibilité (sous une forme jugée acceptable par le commanditaire, y compris une pièce d’identité avec photo délivrée par le gouvernement) : i) pour vérifier l’admissibilité d’une personne au présent concours ; ii) pour vérifier l’admissibilité ou la légitimité d’une participation, du matériel de participation ou de tout autre renseignement soumis (ou prétendument soumis) aux fins de ce concours ; ou iii) pour tout autre motif lorsque le commanditaire le juge nécessaire, à sa discrétion, aux fins de l’administration de ce concours conformément au présent règlement. Le défaut de fournir une telle preuve à la satisfaction du commanditaire dans les délais précisés par le commanditaire pourrait entraîner la disqualification, à la discrétion du commanditaire. Les registres des serveurs du concours constitueront le seul moyen permettant d’attester l’heure aux fins du présent concours.

CONDITIONS DE PARTICIPATION :

EN SOUMETTANT VOTRE PARTICIPATION, VOUS CONVENEZ QUE CELLE-CI (ET CHAQUE ÉLÉMENT INDIVIDUEL DE CELLE-CI, NOTAMMENT LE MATÉRIEL DE PARTICIPATION) RESPECTE TOUTES LES CONDITIONS ÉNONCÉES DANS LE PRÉSENT RÈGLEMENT. LES PARTIES EXONÉRÉES (DÉFINIES CI-DESSOUS) N’ASSUMENT AUCUNE RESPONSABILITÉ QUANT À : I) L’UTILISATION DE VOTRE PARTICIPATION (OU DE TOUT ÉLÉMENT INDIVIDUEL DE CELLE-CI, NOTAMMENT LE MATÉRIEL DE PARTICIPATION) ; II) LA PARTICIPATION À TOUTE ACTIVITÉ LIÉE AU CONCOURS ; III) L’UTILISATION, LA COLLECTE, LE STOCKAGE ET LA COMMUNICATION DE TOUT RENSEIGNEMENT PERSONNEL ; ET IV) LE PRIX ATTRIBUÉ, SI UN PARTICIPANT EST DÉCLARÉ GAGNANT D’UN PRIX (Y COMPRIS TOUTE UTILISATION OU MAUVAISE UTILISATION DU PRIX). VOUS DÉGAGEZ LES PARTIES EXONÉRÉES (DÉFINIES CI-DESSOUS) DE TOUTE RESPONSABILITÉ S’IL S’AVÈRE QUE VOUS AVEZ DÉROGÉ AU RÈGLEMENT DU CONCOURS OU AUX RÈGLES DE LA PLATEFORME SOCIALE OU NE LES AVEZ PAR AILLEURS PAS OBSERVÉS À LA LETTRE. LA PRÉSENTE LIBÉRATION ET INDEMNISATION RESTERA EN VIGUEUR DESSOUS LA FIN DU CONCOURS OU L’ATTRIBUTION D’UN PRIX.

En participant au concours, vous déclarez et garantissez par les présentes que le matériel de participation que vous soumettez :

Le commanditaire ou son agence de promotion ou son modérateur de contenu désigné (l’« examinateur ») se réserve le droit de faire l’examen de tout matériel de participation. Tout matériel de participation que l’examinateur estime, à sa discrétion, enfreindre les conditions énoncées dans le présent règlement peut faire l’objet d’une exclusion. L’examinateur se réserve le droit, à sa discrétion, à tout moment et pour quelque raison que ce soit, de retirer tout matériel de participation (ou une partie de celui-ci) ou de demander à un participant de modifier ou de soumettre de nouveau son matériel de participation (ou une partie de celui-ci) afin qu’il respecte le présent règlement, ou pour toute autre raison. Si une telle mesure est nécessaire à un moment ou à un autre pendant ou après le concours, le commanditaire se réserve le droit, à sa discrétion, de prendre toute mesure qu’il juge nécessaire en fonction des circonstances, notamment d’exclure le matériel de participation (et donc la participation correspondante ou le participant l’ayant soumis), pour que le concours se déroule conformément à l’esprit et à la lettre du présent règlement.

LICENCE :

En participant au concours et en soumettant une participation, vous (et, si vous êtes mineur, votre parent ou tuteur légal) : i) sans limiter les règles de la plateforme sociale, attribuez au commanditaire, à perpétuité, une licence mondiale non exclusive de publication, d’affichage, de reproduction, de modification, de mise à disposition, de communication au public par télécommunication et autrement d’utilisation de votre matériel de participation (et chacun de ses éléments), en totalité ou en partie, aux fins de publicité et de promotion du concours ou pour tout autre motif, dans tout type de média ; ii) renoncez à tous droits moraux sur votre matériel de participation (et sur chacun de ses éléments) en faveur du commanditaire (et de toute personne autorisée par le commanditaire à utiliser ce matériel de participation) ; et iii) convenez d’indemniser les parties exonérées (définies ci-dessous) des réclamations, dommages-intérêts, responsabilités, coûts et dépenses découlant de l’utilisation de votre matériel de participation (ou de tout élément de celui-ci), notamment toute réclamation fondée sur les droits publicitaires, la diffamation, l’atteinte à la vie privée, la contrefaçon du droit d’auteur, l’usurpation de marque de commerce ou tout autre droit lié à la propriété intellectuelle, ou toute autre cause d’action.

PRIX :

DESCRIPTION DES PRIX

Il y aura cinq (5) prix (chacun, un « prix »). Les prix sont les suivants :

• Deux (2) billets de 2 jours en admission générale pour le festival de musique Fuego Fuego au Parc olympique, à Montréal, au Québec, les 25 et 26 mai 2024 (le « festival »), dont la valeur au détail totale approximative de chaque billet est de 236 $ CA. Le stationnement, le transport et l’hébergement ne sont pas inclus, et le gagnant et son invité en sont exclusivement responsables. Le mode de livraison des billets est à la discrétion de Live Nation ; les billets seront envoyés au gagnant par la poste, par courriel ou par la billetterie mobile. Le gagnant pourra également en prendre possession, le jour du festival, à l’endroit convenu. Dans ce dernier cas, le gagnant devra être présent pour récupérer les billets et une pièce d’identité valide avec photo sera exigée. Le gagnant et son invité doivent être âgés d’au moins dix-neuf (19) ans et respecter toutes les politiques relatives au site, au festival et aux événements, qui peuvent être consultées au https://www.festivalfuegofuego.com (ouvre sur un site externe), notamment la présentation d’une pièce d’identité avec photo valide sur le site aux fins de vérification de l’âge ou de l’identité, si demandé. Live Nation se réserve le droit d’annuler le prix, en totalité ou en partie, de tout gagnant ou de tout invité du gagnant si elle considère ou si le personnel du site ou du festival considère, à sa discrétion, qu’il pourrait avoir les facultés affaiblies, représenter une menace pour la sécurité, contrevenir aux politiques ou aux règlements du site ou du festival ou jeter le discrédit sur Live Nation. Le gagnant comprend que le fait de se trouver dans un espace public présente des risques inhérents et que ces risques peuvent exister avant, pendant et après le festival. La revente des billets est interdite. En réclamant les billets, vous acceptez les Conditions d'utilisation de Live Nation et vous vous engagez à respecter les mesures de santé et de sécurité en vigueur au moment où le festival a lieu parmi lesquelles peuvent figurer le port d’un masque ou la présentation d’une preuve de statut vaccinal ou de statut négatif à la COVID-19. Si le festival est annulé, vous en serez informé dès qu’il est raisonnablement possible de le faire.
• L’admission (et, le cas échéant, tout billet) est assujettie aux conditions du festival ; elle doit être acceptée telle qu’attribuée et elle n’est pas cessible ni convertible en espèces (sauf si le commanditaire le permet expressément, à sa discrétion). Aucune substitution n’est permise, sauf si le commanditaire opte pour cette possibilité. Le commanditaire se réserve le droit, à sa discrétion, de remplacer un prix, en totalité ou en partie, par un prix de valeur au détail égale ou supérieure, y compris et à la discrétion du commanditaire par un prix en espèces. Les frais qui ne sont pas expressément indiqués ci-dessus comme faisant partie du prix sont à la charge du gagnant du prix. Les caractéristiques du prix (sauf description contraire figurant expressément ci-dessus) relèvent de l’entière discrétion du commanditaire. Les parties exonérées (définies ci-dessous) ne sont aucunement responsables en cas de retard, de report ou d’annulation de l’activité pour quelque raison que ce soit. Sans limiter ce qui précède, les conditions supplémentaires suivantes s’appliquent à l’égard du prix : i) le gagnant confirmé (et son ou ses invités, le cas échéant) doit disposer de tous les documents nécessaires pour lui permettre de participer au prix (y compris toute preuve valide de vaccination ou d’exemption, les documents attestant d’un test négatif à la COVID-19 ou tout autre document concernant la COVID-19), à défaut, et à la discrétion du commanditaire, il pourrait être disqualifié (auquel cas il perdra ses droits au prix) ; ii) le gagnant confirmé et son ou ses invités, le cas échéant, sont exclusivement responsables des frais de test à la COVID-19, des exigences de quarantaine à l’égard de la COVID-19 et des frais connexes, ainsi que des frais de déplacement ou d’assurance maladie (s’il y a lieu) ; iii) les parties exonérées (définies ci-dessous) ne sont pas responsables du retard, du report, de la suspension ou de l’annulation d’un aspect du prix, pour quelque raison que ce soit (y compris si l’exécution du prix, ou d’une partie de celui-ci, est rendue impossible, irréalisable, dangereuse ou impraticable pour quelque raison que ce soit, notamment en raison d’une maladie ou de risques pour la santé, ou de toute ordonnance, mesure, directive ou orientation d’un gouvernement ou d’une autorité de santé en réponse à une telle maladie ou à de tels risques, notamment celle qui pourrait être mise en œuvre pour atténuer la transmission de la COVID-19, ou en raison d’une loi, d’un règlement, d’un ordre, d’une politique, d’une ligne directrice, d’une grève, d’une restriction de voyage, d’une politique concernant le site, d’une restriction ou d’une autre cause de quelque nature que ce soit liée à une pandémie) et, il est entendu qu’elles ne sont pas tenues d’offrir une compensation ou un prix de substitution à cet égard ; et iv) en acceptant le prix, le gagnant confirmé (et chacun de ses invités, le cas échéant) a) signifie qu’il comprend, reconnaît et accepte que la participation au prix peut comporter un danger ou une exposition à des risques et à des dangers (y compris en raison de la nature du prix et d’une éventuelle exposition à la COVID-19 ou infection à celle-ci), découlant d’erreurs et de négligences humaines prévisibles ou non, et que par conséquent, il pourrait subir des dommages aux biens personnels, une blessure grave, une maladie ou même décéder ; b) signifie qu’il reconnaît et convient que les parties exonérées (définies ci-dessous) ne donnent aucune garantie et ne font aucune déclaration concernant sa sécurité en participant au prix ; c) garantit et déclare qu’il a évalué la nature, la portée et l’étendue des risques en cause, et qu’il accepte et assume librement et volontairement tous les risques de blessures, de maladies, de décès se rapportant à sa participation au prix.

Il y a une limite de un (1) prix par personne.

PROCESSUS DE SÉLECTION DES GAGNANTS :

Le 21 mai 2024 (la « date du tirage ») à 9 h, heure de l’Est, à Toronto, en Ontario, cinq (5) participants admissibles seront sélectionnés par tirage au sort parmi toutes les participations admissibles soumises et reçues pendant la période du concours conformément au présent règlement.

Les chances de gagner dépendent du nombre de participations admissibles soumises et reçues pendant la période du concours conformément au présent règlement.

PROCESSUS DE NOTIFICATION D'UN GAGNANT :

Le commanditaire ou son représentant désigné fera au moins une (1) tentative pour joindre chaque gagnant potentiel d’un prix (à l’aide des renseignements fournis au moment de la participation) dans la journée ouvrable suivant la date du tirage. Si le gagnant potentiel d’un prix ne peut être joint dans un délai de trois (3) jours ouvrables de la date du tirage ou si une notification est retournée pour motif de destinataire inconnu, il pourrait, à la discrétion du commanditaire, être disqualifié (auquel cas il perdra ses droits au prix) et le commanditaire se réserve le droit, si le temps le permet et à sa discrétion, de procéder à un nouveau tirage du prix selon la procédure décrite ci-dessus (avec les modifications nécessaires), auquel cas les dispositions du présent article s’appliqueront à ce nouveau gagnant potentiel.

PROCESSUS DE CONFIRMATION D’UN GAGNANT :

AVANT D’ÊTRE DÉCLARÉ GAGNANT CONFIRMÉ D’UN PRIX, chaque gagnant potentiel d’un prix devra : a) répondre correctement, sans aide mécanique ou autre, à une question d’arithmétique (qui pourra, à la discrétion du commanditaire, lui être présentée en ligne, par courriel ou par un autre moyen électronique, par téléphone ou dans la déclaration d’exonération de responsabilité du commanditaire) ; et b) signer et retourner dans les trois (3) jours ouvrables de la notification la déclaration d’exonération de responsabilité du commanditaire qui établit (notamment) : i) que le gagnant potentiel se conforme au présent règlement ; ii) qu’il accepte le prix tel quel ; iii) qu’il exonère les parties liées au concours, Live Nation Canada, Inc. (« Live Nation »), Gestion Evenko Festival inc. (« festival Fuego Fuego »), Instagram et chacun de leurs dirigeants, administrateurs, employés, mandataires, représentants, successeurs et ayants droit respectifs (collectivement, les « parties exonérées ») de toute responsabilité à l’égard du présent concours, de sa participation à ce concours ou de l’attribution et de l’utilisation ou de la mauvaise utilisation du prix ou d’une partie de celui-ci ; iv) qu’il consent à la publication, à la reproduction ou à toute autre utilisation de son nom, de son adresse, de sa voix, de ses déclarations au sujet du concours ou de sa photo ou de son portrait, sans autre avis ni compensation, dans toute publicité ou annonce réalisée par le commanditaire ou en son nom, peu importe les médias utilisés, y compris la presse écrite, la radiodiffusion ou Internet. Si le gagnant potentiel d’un prix : a) ne retourne pas les documents du concours dûment signés dans le délai précisé ; b) ne peut (ou ne veut) pas accepter le prix (tel quel) pour une raison quelconque ; c) ne répond pas correctement à la question réglementaire ; d) est considéré comme contrevenant au présent règlement (comme le détermine le commanditaire à sa discrétion), il pourrait, à la discrétion du commanditaire, être disqualifié (auquel cas il perdra ses droits au prix), et le commanditaire se réserve le droit, si le temps le permet et à sa discrétion, de sélectionner un autre gagnant potentiel en suivant le processus de sélection d’un gagnant décrit ci-dessus (avec les modifications nécessaires), auquel cas les dispositions qui précèdent s’appliqueront à ce nouveau gagnant potentiel. Le commanditaire prendra la décision définitive quant au choix du gagnant en cas d’égalité ou pour toute autre raison.

CONDITIONS GÉNÉRALES :

Toutes les participations deviennent la propriété du commanditaire. Le concours est soumis à l’ensemble des lois fédérales, provinciales et municipales applicables. Les décisions du commanditaire relativement à toute question liée au concours, notamment les décisions concernant l’admissibilité et la disqualification des participations ou des participants, sont définitives, sans appel et lient tous les participants. TOUTE PERSONNE QUE LE COMMANDITAIRE JUGE AVOIR CONTREVENU AU PRÉSENT RÈGLEMENT, POUR QUELQUE RAISON QUE CE SOIT, S’EXPOSE À SE VOIR DISQUALIFIER À TOUT MOMENT DU CONCOURS, À LA DISCRÉTION DU COMMANDITAIRE.

Les parties exonérées n’assument aucune responsabilité quant à : i) toute défaillance d’un site Web durant le concours ; ii) tout problème technique ou autre problème de quelque nature que ce soit, notamment les problèmes touchant le réseau ou les lignes téléphoniques, les systèmes informatiques en direct, les serveurs, les fournisseurs d’accès, le matériel informatique ou les logiciels ; iii) l’impossibilité de recevoir, de saisir ou d’enregistrer une participation ou d’autres renseignements pour une raison quelconque, notamment en raison de problèmes techniques ou d’un encombrement sur Internet ou sur un site Web ; iv) tout préjudice ou tout dommage subi par l’ordinateur ou un autre appareil du participant ou de toute autre personne par suite de la participation au concours ; v) une combinaison de ces circonstances.

Sans limiter la portée générale de ce qui précède, en participant au concours, chaque participant dégage les parties exonérées de toute responsabilité à l’égard de ce concours et de sa participation à celui-ci.

En cas de litige concernant l’identité de la personne qui a soumis une participation, le commanditaire se réserve le droit, à sa discrétion, d’exiger que toute personne qui prétend être le participant qui a soumis la participation en question prouve à la satisfaction du commanditaire et à la discrétion de ce dernier, qu’il est le participant qui a soumis cette participation. Le défaut de fournir une telle preuve à la satisfaction du commanditaire dans les délais précisés par le commanditaire pourrait entraîner la disqualification (comme le détermine le commanditaire à sa discrétion).

Le commanditaire se réserve le droit, à sa discrétion, de retirer, de modifier ou de suspendre le présent concours (ou d’en modifier le règlement) de quelque façon que ce soit en cas d’événement échappant à son contrôle et entravant le bon déroulement du concours conformément au présent règlement, notamment en cas d’erreur, de problème technique, de virus informatique, de bogue, de manipulation, d’intervention non autorisée, de fraude ou de défectuosité technique. Toute tentative délibérée d’endommager un site Web ou de nuire au bon déroulement du présent concours de quelque façon que ce soit (selon ce que détermine le commanditaire et à sa discrétion) constitue une violation des lois pénales et civiles ; advenant une telle tentative, le commanditaire se réserve le droit de demander réparation et de réclamer des dommages-intérêts dans toute la mesure permise par la loi. Le commanditaire se réserve le droit, à sa discrétion, d’annuler, de modifier ou de suspendre le présent concours ou d’en modifier le règlement de quelque façon que ce soit, sans préavis ni obligation, en cas d’accident, d’erreur d’impression, administrative ou autre, ou pour toute autre raison quelle qu’elle soit. Sans limiter la portée générale de ce qui précède, le commanditaire se réserve le droit, à sa discrétion, de poser une autre question réglementaire comme il le juge opportun selon les circonstances ou pour se conformer aux lois applicables.

En participant au présent concours, chaque participant consent expressément à ce que le commanditaire, ses mandataires ou ses représentants stockent, communiquent et utilisent les renseignements personnels fournis dans le cadre de sa participation aux seules fins de l’administration du concours et conformément à la politique de protection des renseignements personnels du commanditaire (qui peut être consultée au http://www.rbc.com/rensperssecurite/ca/our-privacy-policy.html).

Le présent article ne limite pas la portée des autres consentements qu’une personne peut donner au commanditaire ou à d’autres personnes relativement à la collecte, à l’utilisation ou à la divulgation de ses renseignements personnels.

Le commanditaire se réserve le droit, à sa discrétion, de modifier les dates, les délais et les autres paramètres du concours stipulés au présent règlement dans la mesure nécessaire pour vérifier la conformité d’un participant ou d’une participation au présent règlement, ou à la suite de tout problème technique ou autre, ou à la lumière de toute autre circonstance qui, de l’avis du commanditaire et à sa discrétion, nuit à la bonne administration du concours prévue au présent règlement, ou pour toute autre raison.

En cas de divergence ou d’incompatibilité entre les conditions de la version anglaise du règlement et les divulgations et autres déclarations contenues dans le matériel associé au concours ou un site Web, notamment un bulletin de participation, la version française du présent règlement ou la publicité sur le lieu de vente, télévisée, imprimée ou en ligne, les conditions de la version anglaise du règlement prévalent dans toute la mesure permise par la loi.

Live Nation et le festival Fuego Fuego ne sont pas des commanditaires du concours et ne sont en aucun cas responsables de l’administration du concours, de la vérification des gagnants ou de l’attribution des prix.
